Articles 2 and 5 of the Convention. Effective tripartite consultations. The Committee welcomes the Government’s report on the application of the Convention. It notes the Government’s indication that tripartite consultations are held, but not according to the fixed intervals required by the Convention (once per year), due to its limited administrative structure. The Government indicates its intention to strengthen the implementation of the Convention. In this regard, the Government undertakes to proceed in a transparent and streamlined manner, for instance by adopting a tripartite protocol to ensure that tripartite consultations are held on a regular basis. The Government indicates that workers’ organizations in San Marino have pointed out that, while the Government does make efforts to clarify the position of the social partners prior to each International Labour Conference, a permanent tripartite structure that meets regularly is nevertheless necessary to ensure the holding of tripartite consultations with respect to international labour standards. The Government indicates that one possibility to achieve this could be to revise the functions of the already existing tripartite Labour Commission, which meets on a monthly basis, to ensure that tripartite consultations are held regularly on the matters related to international labour standards covered by Article 5(1) of the Convention. In light of the foregoing, the Committee requests the Government to provide detailed updated information on the measures taken to ensure the holding of tripartite consultations on matters relating to international labour standards at appropriate intervals fixed by agreement, but at least once a year, as required by Article 5(2) of the Convention. It also requests the Government to provide detailed updated information on the frequency, content and outcome of the tripartite consultations held on all matters concerning international labour standards covered by Article 5(1) of the Convention.
