Direct Request (CEACR) - adopted 2023, published 112nd ILC session (2024)

The Committee notes that the Government’s report has not been received despite its urgent appeal in 2019. It hopes that the next report will contain full information on the matters raised in its previous comments.

The Committee notes with deep concern that the Government’s report, due since 2016, has not been received. In light of its urgent appeal launched to the Government in 2019, the Committee proceeds with the examination of the application of the Convention on the basis of the information at its disposal.
Application of the Convention in practice. In its previous comments, the Committee noted that Saint Lucia had concluded reciprocity agreements on social security with the Caribbean Community (CARICOM) countries, the countries of the Organisation of Eastern Caribbean States (OECS), and Canada and requested the Government to provide information on the application of the Convention in practice. The Committee observes that, under section 91 of the National Insurance Regulations of 2003, the payment of social security benefits, including compensation in case of work accidents, may be arranged if a beneficiary permanently resides in another country with which Saint Lucia has not concluded a reciprocal agreement. The Committee requests the Government to provide information on the institutional arrangements put in place to ensure the provision of compensation to beneficiaries residing in a country with which there are no reciprocal agreements, and on the form that such arrangements take. The Committee further requests the Government to provide information on the application of the Convention in practice, including statistical data on the number and nationality of foreign workers employed in Saint Lucia as well as the amount of compensation in case of work accidents paid to persons residing abroad and the country of destination.

The Committee notes with deep concern that the Government’s report, due since 2016, has not been received. In light of its urgent appeal launched to the Government in 2019, the Committee proceeds with the examination of the application of the Convention on the basis of the information at its disposal.
Application of the Convention in practice. In its previous comments, the Committee noted that Saint Lucia had concluded reciprocity agreements on social security with the Caribbean Community (CARICOM) countries, the countries of the Organisation of Eastern Caribbean States (OECS), and Canada and requested the Government to provide information on the application of the Convention in practice. The Committee observes that, under section 91 of the National Insurance Regulations of 2003, the payment of social security benefits, including compensation in case of work accidents, may be arranged if a beneficiary permanently resides in another country with which Saint Lucia has not concluded a reciprocal agreement. The Committee informs the Government that, if it has not supplied replies to the points raised by 1 September 2021, then it may proceed with the examination of the application of the Convention on the basis of the information at its disposal at its next session.

In the direct requests of 2002 and 2008, the Committee requested that the Government supply copies of Acts Nos 5, 12, 13 and 14 of 2001 transposing into national legislation special agreements concluded with CARICOM countries, countries of the Organisation of Eastern Caribbean States (OECS) and Canada, in order to facilitate reciprocity. The Committee appreciates the Government’s statement of its intention to do so, expressed in its latest report of 2011. However, as the report does not specify when the Government intends to send in copies of the said legislation, the Committee requests that it will do so in the very near future. The Committee also requests the Government to supply, in accordance with Part V of the report form, statistical information on how foreign workers and their dependants benefit from compensation in case of occupational accidents (e.g. the number of accidents involving foreign workers and the amounts of compensation paid to them, etc.).
[The Government is asked to reply in detail to the present comments in 2012.]

With reference to its previous comments, the Committee notes the statistical information provided by the Government in its report as regards the number of foreign workers employed in Saint Lucia. It notes, however, that the report does not supply copies of Acts Nos 5, 12, 13 and 14 of 2001 promulgating special agreements concluded with CARICOM and OECD countries, as well as with Canada in order to facilitate reciprocity were transposed into national legislation. The Committee therefore invites the Government to provide the above copies with its next report and to continue to supply with future reports statistical information on the manner in which national, as well as foreign workers and their dependants, benefit from compensation in case of occupational accidents.

The Committee notes the special agreements that have been concluded with CARICOM and OECS territories, as well as with Canada, in order to facilitate reciprocity. These agreements are now reflected in the National Legislation (Acts Nos. 5, 12, 13 and 14 of 2001). The Committee requests the Government to communicate copies of these Acts.

The Committee would also be grateful if the Government would provide, in accordance with Part V of the report form, information on the manner in which the Convention is applied in practice, including statistics on the number and nationality of foreign workers employed in Saint Lucia, the number of accidents involving these workers and the payment of compensation due to them or their dependants in the event of residence abroad, both for States with which Saint Lucia has concluded a reciprocity agreement and for any other States.
