Employment Service Convention, 1948 (No. 88) - Republic of Moldova (Ratification: 1996)

Direct Request (CEACR) - adopted 2021, published 110th ILC session (2022)

Articles 1, 3 and 6 of the Convention. Contribution of the employment service to employment promotion. Activities of the employment service. The Committee previously requested information on the impact of the measures taken by the National Employment Agency (NEA) to promote employment within the framework of its active employment policy, as well as disaggregated data on the users of NEA services, including the number of those who obtain employment through NEA services. The Government reports that, pursuant to Government Decision No. 990 of 10 October 2018, the NEA consists of a central office and 35 territorial employment subdivisions (TES), which operate according to regulations approved by the director of the NEA. The Committee also notes the information provided by the Government on the functions of the NEA and the TES, established by the Act on the Promotion of Employment and Unemployment Insurance (Act No. 105/2018). In addition, the Committee notes the detailed information provided by the Government under the Employment Policy Convention, 1964 (No. 122) regarding the various activities undertaken by the NEA in 2018 and 2019. The Committee requests the Government to continue to provide detailed updated information, including statistical data disaggregated by age, sex and region, on the impact of the NEA’s activities, particularly on the number of workers placed in employment. The Committee also requests the Government to provide updated information on the nature and impact of measures taken by the NEA to facilitate temporary transfers of workers from one area to another as a means of meeting temporary local needs in the supply of or the demand for workers (Article 6(b)(iii) of the Convention).
Article 7. Specialized services for youth and persons with disabilities. In its previous comments, the Committee requested the Government to provide information on the impact of activities implemented by the NEA to promote lasting employment opportunities for young persons and to assist persons with disabilities to find suitable employment on the open labour market. The Committee notes the information provided by the Government in this respect in its report on the application of the Employment Policy Convention, 1964 (No. 122), which includes information on the activities of the NEA conducted in 2018 to promote the employment of persons with disabilities and young persons. The Committee invites the Government to continue to provide information on the manner in which the NEA designs and delivers its services to meet adequately the needs of young jobseekers, persons with disabilities and other specific groups of jobseekers.

Articles 1, 3 and 6 of the Convention. Contribution of the employment service to employment promotion. Activities of the employment service. The Committee notes the information provided by the Government in its report indicating that, in 2012, the National Employment Agency modernized its electronic portal, which coordinates labour supply and demand, and also promotes the use of employment services. The Government indicates that three labour market information centres have been established in the municipalities of Belts, Cahul and Chisinau. It adds that the National Employment Agency has set up a call centre to provide users with information on the labour market. In addition, a national project, the “Jobseekers Club”, has been launched to provide information, vocational guidance and psychological support for the long-term unemployed. The Committee notes that the National Employment Agency conducts annual surveys among economic agents to better determine labour market demands. The Committee requests the Government to provide information on the impact of the measures taken by the National Employment Agency to promote employment within the framework of its active employment policy. Please include disaggregated information on users of employment services, including data on the number who find employment.
Article 7. Specialized services for youth and people with disabilities. The Committee notes the special measures taken to disseminate labour market information among young people, including the creation of a Labour Market Information Centre in Chisinau and vocational guidance and employment centres attached to higher education institutions. It also notes that, according to the statistics, the majority of young people with good career prospects encounter difficulties in finding employment. The Government indicates that the National Employment Agency, together with central and local public authorities and the social partners, is planning to develop employment programmes for persons with disabilities. Specialists from the National Employment Agency receive training from organizations involved in the social integration of persons with disabilities. The Government reports that, in 2013, employment agencies registered 565 persons with disabilities, which represents an increase of 70 persons in relation to 2012. In 2013, 1,076 persons with disabilities benefited from labour mediation and career counselling, which was three times more than in 2012. The Committee refers to its 2014 comments on the Employment Policy Convention, 1964 (No. 122), and requests the Government to provide information on the impact of the activities carried out by the National Employment Agency to promote lasting employment opportunities for young workers. The Committee also requests the Government to provide information on the impact of the measures adopted to assist persons with disabilities to find suitable employment in the open labour market.

The Committee notes the Government’s detailed report received in August 2009 and the information on the continuation of the programmes especially in regard to youth. It invites the Government to continue providing specific information on the operation of the National Employment Agency both at national and local levels. Please also continue to provide statistical data disaggregated by sex and by territorial agencies on the unemployed persons registered and the number of persons placed in work by the National Employment Agency.

Further to its previous comments, the Committee notes with interest that the tripartite Administrative Council of the National Population Employment Agency is actively involved in addressing the problems of the organization and operation of the population employment agencies. Advisory councils have been established at local levels. As also requested in its comments under the Employment Policy Convention, 1964 (No. 122), regarding consultation of the representatives of persons affected by the measures taken, the Committee would appreciate continuing to receive specific information on the operation of the Administrative Council both at national and local levels. Please also continue to provide statistical data disaggregated by sex and by territorial agencies on the unemployed persons registered and the number of persons engaged in work by the National Population Employment Agency (Articles 4 and 5 of the Convention).

The Committee notes the information provided in the Government’s detailed report for the period ending August 2001, in particular information provided in response to previous comments. It would appreciate receiving further information on the following points.

Article 3, paragraph 2, and Articles 4 and 5 of the Convention. The Committee notes the information provided firstly on the draft legislation to create a National Employment Agency, which would have branches in each district, and secondly on the draft Law on Employment and Social Protection of the Unemployed, which will establish an institutional framework for specifying the roles of ministries, unions, employers’ organizations, and local authorities. The Committee trusts that this draft legislation will take into account the requirements under Articles 4 and 5 to ensure the cooperation of representatives of employers and workers in the organization and operation of the employment service and in the development of employment service policy, through the establishment of tripartite consultative committees. It would appreciate receiving copies of the legislation after enactment as well as the particulars required by the report form, on the arrangements made to give effect to the abovementioned provisions of the Convention.

Article 7. The Committee notes the Government’s statement that employment offices are not specialized by occupation or industry, due in part to current economic conditions; but the Government will take measures in this respect once economic recovery is under way. The Committee would appreciate being kept informed of any such changes.

1. The Committee notes the Government's first report. It would be grateful if the Government would include in its next report information on: how the employment service meets the changing requirements of the economy and the working population (Article 3, paragraph 2, of the Convention); the number of advisory committees established nationally, how they are constituted, and the procedure adopted for the appointment of employer and worker representatives (Article 4, paragraph 3, and Article 5); and the arrangements made to encourage full voluntary use of employment service facilities (Article 10).

2. The Committee notes that, in view of the economic crisis in the country, the Government does not for the time being envisage making any specialized arrangements for occupations, industries or special categories of applicants, as required by Article 7 of the Convention. It hopes that the Government will give particulars in its next report of progress made in giving effect to this Article.

3. Part III of the report form. Please supply information on the system of inspection, if any, of the organization and operation of the public employment offices.

4. Part IV of the report form. Please furnish published statistical information on the number of public employment offices established, the number of applications for employment received, the number of vacancies notified and the number of persons placed in employment by such offices. Please also send available reports on the organization of the activities of the public employment service.

5. Part VI of the report form. Please give a general appreciation of the manner in which the Convention is applied, together with information on any practical difficulties encountered in applying it.
