Repetition The Committee notes receipt of the two laws sent by the Government, namely the Law on Safety in Mines (Law No. 8741 of 15 February 2001) and the Law on the Use of Explosives (No. 9126 of 29 July 2003). The Committee notes, however, that the information provided by the Government does not include sufficient detailed information on the effect given to the requirements under each Article of the Convention to enable the Committee to evaluate the application of the Convention in the country. The Committee reiterates that the Office would be disposed to provide any further technical assistance regarding the required effect to be given to the present Convention, should the Government so request. The Committee asks the Government to provide information in its next report on the application of the Convention, in law and in practice, referring to specific provisions in law that apply the individual requirements under the Convention; and to provide information on how the Convention is applied in practice, with reference to Part V of the report form.

The Committee notes the general information provided by the Government in its first report and that relevant legislation, i.e. the Law on Safety in Mines (Law No. 8741 of 15 February 2001) and the Law on the Use of Explosives (No. 9126 of 29 July 2003) were not attached to the first report and have not, as requested, been made available to the Committee. On this basis the Committee has been unable to examine the application by Albania of the present Convention. With reference to the Committee’s comments on the application by Albania of the Occupational Safety and Health Convention, 1981 (No. 155), the Committee notes that the Government is engaged in significant legislative reform in the area of occupational safety and health; that, pursuant to a request from the Government, the Office has provided technical comments on a draft comprehensive law on occupational safety and health; and that the Office would be disposed to provide any further technical assistance regarding the required effect to be given to the present Convention, should the Government so request. The Committee requests the Government to take the obligations under the present Convention into account in the context of the ongoing legislative reform and to submit copies of any relevant new legislation once adopted.
