Employment Service Convention, 1948 (No. 88) - Belarus (Ratification: 1995)

Direct Request (CEACR) - adopted 2016, published 106th ILC session (2017)

Contribution of the employment service to employment promotion and participation of the social partners. The Government indicates that trade unions and employer associations participated in drafting the State employment programme for 2015, endorsed by the Council of Ministers in February 2015. In 2013, the Government and the national employers’ and workers’ organizations entered into a General Agreement in which they undertook to develop and implement, on an annual basis, the employment promotion programmes of the State and the regions. The Government reports that the tripartite National Council for Labour and Social Affairs continues to meet at least once every six months to examine the implementation of the General Agreement. Employment issues were discussed at the 11 meetings held by the National Council from 2011 to 2015 as well as at meetings of the sectoral and territorial councils on labour and social affairs. As of 1 July 2015, there were 300 territorial councils (provincial, municipal and district) and 22 sectoral councils for labour and social questions. The Committee requests the Government to continue to provide information on the measures taken or envisaged by the public employment service to ensure the effective recruitment and placement of workers. The Committee also invites the Government to report on the activities of the National Council on Labour and Social Affairs and other local tripartite councils on the subjects covered by the Convention.
Article 7 of the Convention. Measures for particular categories of applicants for employment. The Government indicates that the employment programmes developed each year at the State and regional levels each contain a specific section on measures for finding employment for socially vulnerable categories of people. In 2014, 15,900 unemployed people unable to compete equally in the labour market, including young people and persons with disabilities were placed in permanent jobs. In addition, as a result of decisions taken by local executive and management bodies in 2015, companies were required to reserve jobs for 20,100 people, including 1,800 people with disabilities, 4,400 young people under 21, and 6,100 people recently released from penal establishments. The Committee invites the Government to continue to provide information, including up-to-date statistics, on the impact of measures taken by the public employment service to meet the employment needs of particular categories of applicants for employment, such as young persons, women, the long-term unemployed and persons with disabilities. Please also provide specific information on the measures taken to facilitate specialization by occupation and by industry in the various employment offices.
Article 10. Full use of the employment service. The Government highlights the important role that the social partners play in developing and implementing measures of state policy for promoting employment. Moreover, job creation, primarily in small towns and rural communities, continues to be a priority of the State Employment Programme. This means, in practice, incentivizing employers to create jobs and helping unemployed people to set up their own businesses. The Committee notes that, in 2014, the provincial executive committees made loans from their own budgets to 31 companies in order to create jobs for 243 people, including 17 companies in small towns and seven in rural localities. In addition, financial, organizational and practical support was provided to 2,000 unemployed persons, to set up their own businesses. The Committee further notes the information provided by the Government regarding its automated job vacancy information system, the “all Republic vacancy databank”, which advertises approximately 1,000 vacancies in rural areas, to promote internal migration. In 2014, the databank was consulted over seven and a half times more frequently than in 2010. The Committee also notes measures taken to promote innovation in business, in the form of increased subsidies offered to unemployed persons setting up businesses integrating scientific research and development. The Committee requests the Government to continue to provide information on the impact of the measures adopted, in collaboration with the employers’ and workers’ organizations, to encourage full use of the employment service by employers and workers on a voluntary basis, as well as information on the impact of such measures.
Statistics. Application of the Convention in practice. The Committee welcomes the detailed statistics provided by the Government regarding the numbers of unemployed people and job placements, as well as the number of vacancies over the period 2010–15. It invites the Government to continue to provide updated statistical information concerning the number of public employment offices established, the number of applications for employment received, the number of vacancies notified, and the number of persons placed in employment by such offices.

Contribution of the employment service to employment promotion and participation of the social partners. The Committee notes the information and statistical data provided by the Government in its report for the period ending in May 2010. The Government reports that employers’ and workers’ organizations participated in the preparation of the State Employment Programme 2009–10. The Government indicates that the tripartite National Council on Labour and Social Affairs examines the implementation of the General Agreement in its meetings at least twice a year. The National Council approved the draft set of measures and action plan 2010 to implement the State Employment Programme 2009–10. The Government indicates that in the first half of 2010, there were 275 regional councils for labour and social affairs (provincial, municipal and district) and 19 sectoral councils. The Committee invites the Government to provide information in its next report on the activities performed by the public employment service to ensure effective recruitment and placement of workers. It also invites the Government to continue to report on the activities of the National Council on Labour and Social Affairs and other local tripartite councils on the subjects covered by the Convention.
Article 7 of the Convention. Measures for particular categories of applicants for employment. The Government indicates that the activities of the public employment service are set out in the Regulations on the public employment service approved by Decree of the Council of Ministers No. 221 of 18 February 2010. Under these Regulations, the public employment service is established to implement state policy in the field of employment promotion and to provide jobseekers with the appropriate services. The Government indicates that in the annual State and regional employment promotion programmes, individual departments envisage measures to find employment for particular disadvantaged categories of jobseekers, such as young persons, persons with disabilities, women and the long-term unemployed. The Committee invites the Government to continue to provide information on the measures taken by the public employment service to meet the employment needs of particular categories of applicants for employment, such as young persons and persons with disabilities. Please also provide specific information on the measures taken to facilitate specialization by occupations and by industries in the various employment offices.
Article 10. Full use of the employment service. The Government indicates that one of the priorities of the State Employment Programme is to encourage employers to create jobs, primarily in small towns and rural locations, and to provide assistance to the unemployed in starting a business. In 2009, employers created 3,200 jobs for placement of unemployed persons, including 500 rural jobs and 1,600 in small towns. The Committee notes that a national computerized vacancy database has been set up which contains information on vacancies in rural areas with housing provided. Furthermore, under the Regulations on assistance to the unemployed in starting their own business, approved in March 2008, assistance is provided through work, employment and social protection agencies. In 2009, financial support for business start-ups was provided to 2,700 people. The Committee asks the Government to continue to provide information on the measures adopted, in collaboration with employers’ and workers’ organizations, to encourage full use of the employment service by employers and workers on a voluntary basis.
Parts IV and VI of the report form. Information on the practical application of the Convention. The Committee notes the statistics provided by the Government indicating that 37,000 unemployed persons were registered at the beginning of 2009 and 212,600 persons during the entire year. The public employment service placed 196,200 persons in employment in 2009 and 25,000 persons benefited from vocational training. The Government reports that, in 2009, 25,600 jobseekers were placed in subsidized employment, including 1,800 persons with disabilities, 6,800 young people under the age of 21 and 2,200 persons released from penal establishments. The Committee invites the Government to include in its next report updated statistical information concerning the number of public employment offices established, the number of applications for employment received, the number of vacancies notified, and the number of persons placed in employment by such offices.

1. The Committee notes the information and statistical data provided by the Government in its report for the period ending in May 2005. It asks the Government to provide additional information on the following points.

2. Articles 4 and 5. The Government indicates that the National Council on Labour and Social Affairs, which includes government, employers’ and workers’ representatives in equal numbers, functions as an advisory body within the country. The National Council’s main task is to examine socio-economic policy issues and conclude general agreements. The Committee notes that a general agreement defining each party’s position regarding the main lines along which social and labour relations would be regulated was signed in 2004. The agreement contains a section on the development of the labour market and on guarantees with regard to employment. The Committee also notes that tripartite councils on labour and social affairs have been set up at industrial and local levels. It asks the Government to continue to report on discussions of employers’ and workers’ representatives in the National Council and any recommendations made in the Council on the subjects covered by the Convention. Please also provide information on the activities of the councils on labour and social affairs that have been set up at industrial and local levels in relation to the operation of the State Employment Service.

3. Article 7. The Committee notes the Government’s indication that there is no specialization by occupations and by industries within the various employment offices, except for the Minsk City Employment Office, where special departments have been set up in order to facilitate the placement in work of persons with disabilities and young people. The Committee invites the Government to continue to provide information on any progress with regard to the arrangements envisaged in order to give effect to Article 7 in other regions of the country.

4. Article 10. The Government indicates that every year the State Employment Service devises the State Programme for the Employment of the Population. Its main priorities include encouraging employers to create jobs, promoting entrepreneurial initiative and supporting the self-employment of the unemployed. In 2004, 138 enterprises were given financial assistance amounting to 16,484 billion roubles, thus creating 1,833 jobs. The Committee asks the Government to continue to provide information on the measures adopted, in collaboration with employers’ and workers’ organizations, to encourage full use of the employment service by employers and workers on a voluntary basis.

5. Parts IV and VI of the report form. The Committee asks the Government to continue to provide statistical information concerning the number of public employment offices established, the number of applications for employment received, the number of vacancies notified, and the number of persons placed in employment by such offices. Please also provide a general appreciation of the manner in which the employment service operates in practice.

The Committee notes with interest the Government's first two reports on the application of the Convention. It has also taken note of the provisions of Decree No. 253 of 28 June 1991 with respect to the public employment service, amended by Decree No. 382 of 11 June 1993. To allow a better appreciation of the application of the Convention in practice, the Committee would be grateful if the Government would provide additional information on the following points in its next report.

Article 3, paragraph 2, of the Convention. The Committee notes that, in the Government's opinion, the employment centres are well distributed and sufficient in number to provide satisfactory services throughout the country. Please indicate whether a general examination of the organization of the network of employment offices has been carried out or is being contemplated.

Articles 4 and 5. Please indicate how in practice the conciliation committees ensure collaboration of employers' and workers' organizations in the organization and operation of the employment service, and in the development of employment service policy.

Article 7(a). Please indicate the measures taken or contemplated, to facilitate within the various employment offices specialization by occupations and by industries or, if appropriate, indicate the reasons for which such specialization does not appear to be necessary.

Article 10. Please describe the measures taken to encourage full use of employment service facilities by employers and workers on a voluntary basis.

Parts IV and VI of the report form. The Committee notes the statistical data provided by the Government in its report on the application of Convention No. 122. Please continue to provide the most detailed information available on the nature and volume of activities of the employment offices. Please also provide a general assessment of the effectiveness of the employment service.
