The Committee takes note of the Government’s report for the period ending 31 May 2013. As in the reports that it has presented since the ratification of Convention No. 107, the Government indicates that Cuba has a homogeneous population and no tribal or semi-tribal peoples, and that it is therefore unnecessary to promulgate the special legislation referred to in the Convention. The Government states that the Cuban people have a clear cultural identity which is the product of an intensive process of transculturation. It adds that there are no ethnic minorities in Cuba. The Committee recalls that the Governing Body invited States parties to Convention No. 107 to contemplate ratifying the Indigenous and Tribal Peoples Convention, 1989 (No. 169), which will, ipso jure, involve the immediate denunciation of Convention No. 107 (GB.270/LILS/3(Rev.1), November 1997). The Committee observes that in Latin America the term “tribal” has been applied to certain communities of African descent, as indicated in the Handbook for ILO tripartite constituents on Convention No. 169, published by the Office in February 2013. The Committee invites the Government to indicate in its next report whether it has considered the possibility of ratifying Convention No. 169. The Committee further invites the Government to consider the desirability, in its next report on Convention No. 107, of including indications regarding Cuba’s communities of African descent, bearing in mind that the cultural values of those communities could come within the scope of application of some of the Convention’s provisions.
