The Committee last examined this case at its November 2003 session, where it requested the Government to continue to keep it informed in respect of remaining claims pending before the Social Revindication Commission (the “Commission”), and of any further developments in respect of the Employees’ Recreation Fund [see 332nd Report, para. 145].
  2. 117. In a communication of 8 January 2004, the Government indicates that there are no cases currently pending before the Commission. The Supreme Administrative Court (the “Court”) is currently examining: complaints against three decisions of the Commission concerning the restitution of assets of NSZZ Solidarnosc, forfeited under martial law; and a complaint against a decision concerning restitution of assets of the Miners’ Federation of Trade Unions, also forfeited under martial law. The judgements of the Court will determine whether these cases may be returned before the Commission (if the Court reverses or invalidates a given decision). As regards the case mentioned in the Government’s previous communication, the Court has dismissed the extraordinary appeal filed by the Public Prosecutor General; the decision of the Commission thus came into force.

The Committee takes note of this information and requests the Government to continue to keep it informed in respect of the remaining claims pending before the Social Revindication Commission and the Supreme Administrative Court. It also requests the Government to keep it informed of any further developments in respect of the Employees’ Recreation Fund.
