The Committee last examined this case at its meeting in November 2001 when it noted with interest that the amendments to the Act on the Settlement of Collective Disputes ensuring participation of workers’ and employers’ organizations concerned in the determination of minimum services had been prepared and submitted to the social partners for their observations, and that the provisions of this Act had been included in the draft Labour Code which was also being discussed with the social partners [see 326th Report, paras. 99-101].

In its communication dated 21 December 2001, the Government indicates that the draft Labour Code, after comprehensive discussions with the social partners, was approved by the Tripartite Board of the Republic of Lithuania as well as by the Government and was submitted to Parliament for adoption. The Labour Code includes provisions concerning the regulation of collective disputes as well as provisions providing for consultation with the parties to a collective dispute for the determination of minimum services during a strike. Once the Labour Code will be in force, the old Law on Regulation of Collective Disputes will no longer be applicable.
- 76. The Committee takes note of this information with interest and requests the Government to provide it with a copy of the new Labour Code once it has been adopted by Parliament. The Committee draws this case to the attention of the Committee of Experts on the Application of Conventions and Recommendations.
